Terms and Conditions

All Aimm system hardware, software and services are provided under the following Terms and Conditions.  

If these are not acceptable you must immediately cease using the system and advise us.   

By using your password to access this website, making use of any of the data produced by the Aimm system, paying any invoice for services provided by Aimm, or continuing to use the system in any way you indicate your acceptance of these Terms and Condition.   

  • 'Aimm' means a trading division of Aerodrome IT Systems Ltd.
  • On 1st April each year, Aimm's Fees and charges are automatically adjusted without notice by the change in the Consumer Price Index for the previous calendar year.
  • 'Aerodrome' means an Aerodrome, Airport, Airfield, Heliport, Flying School, Club, Owners Syndicate or any other entity providing goods and services to aviators.
  • 'Pilot' means a Pilot, Aircraft Operator or any other entity that incurs Aviation related costs.
  • 'Movement' means an Aircraft Landing, Takeoff, Touch and Go, Approach and Go Around, Parking fee, Subscription, Rental or any other goods or services charged to a Pilot by an Aerodrome.

Aimm is appointed by its client aerodromes to collect data on airspace activity and aircraft movements and / or positions of mobile devices that are airside, by recording and transcribing voice radio calls, ADSB transmissions, images of aircraft movements, direct observation, mobile device positions, and other methods, to monitor activity in order to provide information to the level required by each client. Aerodromes typically use this for maintenance and improvement management, safety monitoring, reporting to Environmental, Operating Consent, Local Authority, Civil Aviation Authorities, Incident Investigation, Assisting with Search and Rescue events and Billing of movements. Camera / radio / computer equiment for this purpose is leased or owned by the aerodrome operator, under their control, and located on or near their premises.

 

Authorised Aerodrome personel or Aimm personel are able to enter aircraft registrations with time of movement, but cannot view the aircraft operator names or addresses unless they are directly involved with producing invoices to send to pilots. Aimm personel are bound by contractural obligations of secrecy.

 

Aimm makes no judgement as to the correctness or reasonableness of any movement fee specified by an aerodrome, and makes no warranty as to the fitness for use of any aerodrome.  Aimm makes no warranty as to fitness for purpose of the software or any hardware supplied by it, except that if any programming or operational errors, or hardware faults, are detected within 12 months of initial supply, and these are advised to Aimm with sufficient information to reproduce the fault, then Aimm will use its best efforts to promptly correct the fault, modify its operational procedures, and/or send the corrected software/hardware to the user at no charge.   Aimm will use good methods to protect against viruses and malware, but does not warrant that it will always be virus and malware free.  

 

Aimm has robust system monitoring, data collection and retention methods, however no liability arising from error, loss or corruption of data will be accepted by Aimm. It is a condition of use of Aimm that there will be no compensation to any party for any losses that might occur as a result of faults in any part of the Aimm system or its services, and that should compensation be awarded to any party in any forum, that this will be limited to no more than the total of fees paid by the affected party to Aimm for its services in the preceeding twelve months. 

 

Aimm uses a secure server with encrypted data transfer, and uses good I.T. Industry practices for security and confidentiality of data. Data is deleted immediately there is no longer a need for it to be retained.  Aimm will not pass to any third party, email addresses or other information that identifies an individual flight, pilot, aircraft or airport, for any purpose other than for operations and development of its own system, for assisting its Client Airports to manage their reporting requirements and debtors, and on rare occasions to assist Search and Rescue , Incident Investigation, or other officially sanctioned purposes.

 

These Terms & Conditions are subject to change without notice. Any changes will be incorporated into these Terms & Conditions posted on this webpage, and a printed copy available on request.

Aimm's Standard Contract with its Clients...   use of the system is deemed to be acceptance by both Aimm and the Client unless modifications have been agreed in writing by both parties.

1. INSTALLATION: AIMM will supply and support the Aimm recording unit and software, by monthly subscription, to the AIRPORT.  Hardware is supplied by AIMM on a maintaned lease, and remains the property of AIMM.

 

2. POSITION of EQUIPMENT: The AIRPORT will provide a location with clean power for the equipment, at or as near as possible
to the AIRPORT.   The AIRPORT will ensure that the equipment is housed per the manufacturer's instructions, inspected per any applicable governmental and company requirements and any abnormalities investigated.

 

3. RADIO ANTENNAE: The AIPORT will not connect any other device to the antennae used by Aimm. 

 

4. DATA COLLECTION: AIMM will collect data on behalf of the AIRPORT, to provide those services that the Airport requires, and for the purposes of Aimm's own business.   Equipment will record radio transmissions and archive for later analysis if required.  The System will be monitored for normal performance checks of the software.
Consultation with the Civil Aviation Authorities indicate that the information about a pilot's intentions is relevant to all parties in the AIRPORT area, including other pilots, the AIRPORT operators and any other parties who may be affected by the aircraft movements and AIMM will be collecting the information on behalf of the AIRPORT, and for the operations and development of its own business.


5. DISPUTES: If either party has a grievance they will notify the other party of the issue and make all reasonable efforts to resolve the issue.

 

6. TERMINATION OF SERVICE: If either wishes they may terminate the service on three month's notice, with no fault no liability and no compensation to or from either party.   A handover solution will be agreed. See point 8.a. for AIRPORT obligations regarding return of AIMM hardware and applicable charges until hardware is returned. 

 

7. LIABILITY: Any liability for damage or loss arising from faulty components, assemblies or software not manufactured or created by AIMM is to be directed at the manufacturer/creator of those items. If any programming or operational errors, or hardware faults, are detected within 12 months of initial supply, and these are advised to AIMM with sufficient information to reproduce the fault, then AIMM will use its best efforts to promptly correct the fault, modify its operational procedures, and/or send the corrected software/hardware to the user at no charge. It is a condition of use of AIMM that this is the total extent of AIMM's warranty and liability, and that should compensation be awarded to any party in any forum, that this will be limited to no more than the total of fees charged by AIMM as payment for its services, for movements by the affected party during the preceding twelve months.

 

8. CHARGES FOR SERVICES: As advised to each client.   Rates are subject to annual adjustment for changes in the Consumer price Index, or as notified by AIMM.

 

8.a.  CHARGES FOR AIMM HARDWARE NOT IN USE: If the Aimm service is terminated, or a situation arises outside AIMM's control where AIMM's hardware is in the possession of the AIRPORT but is not in use then the base monthly subscription charge will be applied to cover the rental of the hardware. The AIRPORT agrees to package and arrange return of AIMM hardware in working order at the AIRPORT's expense. 

 

9. PRIVACY STATEMENT: The radio call recordings and / or images are archived for a minimum of three years on the AIMM unit on-site at the AIRPORT.  AIMM uses a secure server and encrypted data transfers with the data exchange being initiated by the on-site unit.  Aimm will not pass to any third party, email addresses or other information that identifies an individual flight, pilot, aircraft or airport, for any purpose other than for operations and development of its own system,  for assisting its Client Airports to manage their reporting requirements and debtors, and on rare occasions to assist Search and Rescue , Incident Investigation, or other officially sanctioned purposes.

 

10. EMAIL SUPPORT will be provided by AIMM.   Minor support is included in the monthly subscription, more extensive support and training of  new Transcription Operators after the system has been in operation for three months, will be charged at industry rates.


11. MONITORING and DATA ENTRY:   Either AIMM or the Client's own staff  / contractors can transcribe the radio calls, or examine the images, and enter movements. 

 

12. REPORTING: A Management 'Dashboard Report', 'Movement Report' spreadsheet, and if required a 'Billing report' in the format specified by the AIRPORT, will be emailed each month, normally within a week of the end of the month.   'Compliance Reports' are sent at the appropriate intervals.


13. AIRPORT will notify aircraft operators and AIMM in advance of any proposed changes of their landing fee and other fee billing structures.  If these require changes to the AIMM software a quotation for this work will be prepared for the AIRPORT to approve.

 

14. DEBTORS and EXEMPT AIRCRAFT: The AIRPORT will keep up to date the Debtors and Exempt / Special Fee lists on the AIMM website for relevant debtors / Aircraft using their Airport.  

 

15.  USE OF AIMM UNIT: The AIRPORT agrees not to modify or tamper with the AIMM unit without the prior approval of AIMM. This includes but is not limited to: Installing any software; Opening the case; Modifying any settings, files or permissions; Attaching any non-supplied hardware.
